MOBILE, Ala. — An Alabama federal judge has denied a plaintiff’s motion to remand a Boston Scientific Corp. cardiac stent action, ruling that it is facially apparent from the factual allegations in the complaint that the amount in controversy exceeds the jurisdictional threshold.
In a Dec. 19 order, Judge William Steele of the U.S. District Court for the Southern District of Alabama noted that Ward seeks to recover damages for serious injuries and medical procedures allegedly caused by BSC’s tortious conduct in designing and distributing the device.
