Pa. Court Upholds $2.43 Million Transvaginal Mesh Judgment, Says Delay Damages Proper

PHILADELPHIA — A Pennsylvania appellate court has upheld a $2.43 million judgment in a transvaginal mesh case, ruling that the imposition of delay damages on Ethicon was proper because its failure to timely file its post-trial motion prejudiced the plaintiff.

In a Dec. 21 opinion, the Pennsylvania Superior Court said the plaintiff was entitled to view the judgment as final after defendants failed to file their motion within the 10-day deadline and that allowing the motion will only cause the plaintiff further harm.
