Plaintiffs in Wright Profemur Hip Action May Not Further Amend Complaint, Judge Rules

HARTFORD, Conn. — A Connecticut federal judge has denied a couple’s request to further amend their complaint in a Wright Medical Profemur Hip lawsuit, noting the plaintiffs were already given the opportunity to file a final amended pleading.

In a Nov. 19 order, Judge Janet Arterton of the U.S. District Court for the District of Connecticut also denied plaintiffs’ alternative motion to reconsider her dismissal of their claims for design defect, malfunction theory and negligence claims. Plaintiffs cited no new legal or factual developments warranting reconsideration, the judge held.
