Chapter 7 Trustee May Pursue Claims in Taxotere MDL, La. Federal Judge Rules

NEW ORLEANS — A Louisiana federal judge has held that a Chapter 7 trustee may pursue product liability claims in the Taxotere MDL, ruling that while the plaintiff is estopped from litigating her claims because she failed to disclose them on her bankruptcy petition, the trustee is innocent of any wrongdoing.

In the Oct. 16 order, Judge Jane T. Milazzo of the U.S. District Court for the Eastern District of Louisiana dismissed the loss of consortium claim filed by the plaintiff’s husband, noting that it is derivative of the claims.
