MINNEAPOLIS — A plaintiff plans to appeal a Minnesota federal judge’s dismissal of his St. Jude Medical mechanical heart valve action on express preemption grounds, according to a recent filing.

According to a Sept. 27 notice of appeal filed in the 8th Circuit U.S. Court of Appeals, the plaintiff will challenge the federal court’s determination that he failed to allege a violation of state law requirements that parallel federal law.
