Ga. Federal Judge Allows Manufacturing Defect Claim to Proceed in Zimmer NexGen Knee Case

ATLANTA — A Georgia federal judge has denied Zimmer Biomet Holdings Inc.’s motion for summary judgment on a manufacturing defect claim in a NexGen knee case, ruling that the plaintiff has provided sufficient evidence that the device did not operate as intended.

However, in the Sept. 27 order, Judge Michael L. Brown of the U.S. District Court for the Northern District of Georgia awarded Zimmer summary judgment on the plaintiff’s failure-to-warn claim, ruling it is barred by the learned intermediary doctrine.
