Mediator Appointed to Oversee Settlement Talks in BHR Hip THA Cases

BALTIMORE — The Maryland federal judge overseeing the Smith & Nephew Birmingham Hip Resurfacing MDL docket has appointed a special mediator “to explore potential settlement” of cases involving a BHR component or an R3 component as part of a total hip replacement construct (THA).

In an Aug. 28 order, Judge Catherine C. Blake of the U.S. District Court for the District of Maryland tapped John W. Perry Jr. of Perry Dempf Dispute Resolutions as a special mediator to assist the parties in attempting to settle the approximately 100 THA and R3 cases that are pending in the MDL.
