KNOXVILLE, Tenn. — Exactech Inc. is urging a Tennessee federal judge to award it summary judgment in a case targeting its AcuMatch hip implant, arguing that the claims are time-barred because the Texas statute of repose expired one year before the lawsuit was filed.
In a Sept. 11 reply filed in the U.S. District Court for the Eastern District of Tennessee, Exatech contends that none of the exceptions to the statute of repose apply.
