7th Cir. Refuses to Reconsider Decision Overturning $3 Million Verdict in Paxil Suicide Case

CHICAGO — A federal appeals court has refused to reconsider its decision overturning a $3 million wrongful death verdict in a case in which a law firm partner committed suicide a week after he began taking GlaxoSmithKline’s antidepressant Paxil.
On Sept. 20, 7th Circuit U.S. Court of Appeals denied Wendy Dolin’s petition for review en banc, in which she sought to challenge an appellate panel’s determination that her claims are preempted because federal law would have prevented GSK from adding a warning that Paxil can cause suicide in adults.
