NEW YORK - A federal judge awarded summary judgment to the manufacturer of Rezulin in three Mississippi cases involving plaintiffs seeking to recover damages for fear of future injury. In re: Rezulin Products Liability Litigation, MDL No. 1348 (S.D. N.Y.).
Plaintiffs Frederick Alexander, Darlene McRee and Bobbie Pittman each admit that they did not sustain any injuries as a result of ingesting the diabetes drug, but allege that their use of the drug may lead to injuries in the future, the April 7 order states.
