NEW YORK - In an order entered March 14, U.S. District Judge Lewis Kaplan denied a motion to certify a proposed class consisting of all Maryland residents who purchased and/or ingested Rezulin based on the court's ruling dated Sept. 12, 2002. In re: Rezulin Products Liability Litigation, MDL No. 1348 (S.D.N.Y.)
Judge Kaplan opined that the proposed class in Lepley (n/k/a Carter) v. Pfizer Inc., No. 24-C-01-005171 (D. Md.) does not 'differ materially' from the classes defined and the claims for which relief was sought by the Plaintiffs' Steering Committee.
