ST. LOUIS - The advertising used to promote Hydroxycut, an ephedra-based weight loss supplement made by Ontario-based MuscleTech Research and Development, Inc., violates the Missouri Merchandising Practices Act, according to a March 27 suit filed by Missouri Attorney General Jay Nixon. Jeremiah (Jay) Nixon v. Muscletech Research & Development, Inc., No. N/A (Mo. Cir. Co., St. Louis).
According to the lawsuit, Muscletech's promotional materials make unsubstantiated claims that the supplement is 'clinically proven' to be a 'fat burner,' and do not warn consumers about the potential dangers of using the product.
