Ethicon, J&J to Appeal Denial of New Trial in Prolift Transvaginal Mesh Case

HAMMOND, Ind. – Ethicon and Johnson & Johnson have asked the 7th Circuit U.S. Court of Appeals to review an Indiana federal judge’s denial of their motion for judgment as a matter of law and a new trial following a $35 million jury verdict in a Prolift transvaginal mesh action.

According to a Sept. 6 notice of appeal, the companies are challenging an Aug. 8 ruling in which Judge Philip P. Simon of the U.S. District Court for the Northern District of Indiana found the evidence supported the jury's findings.
