Widow Seeks En Banc Review of Decision Overturning $3 Million Paxil Verdict

CHICAGO — The widow of a law firm partner who committed suicide a week after he began taking GlaxoSmithKline’s antidepressant Paxil has asked a federal appeals court for en banc review of a panel’s decision overturning a $3 million wrongful death verdict.
Plaintiff Wendy Dolin filed the petition on Sept. 6, challenging the 7th Circuit U.S. Court of Appeals’ determination that her claims are preempted because federal law would have prevented GSK from adding a warning that Paxil can cause suicide in adults.
