Ala. Federal Judge Remands Amiodarone Death Case for Lack of Diversity

BIRMINGHAM, Ala. — An Alabama federal judge has remanded an amiodarone wrongful death case to state court, finding the complaint states a valid cause of action against the non-diverse physician defendants.

On Aug. 2, Chief Judge Karon O. Bowdre of the U.S. District Court for the Northern District of Alabama concluded that the non-diverse defendants were not fraudulently joined.

Frank Dixon died on Feb. 18, 2016, allegedly from “amiodarone toxicity and amiodarone induced intestinal lung disease.”
