SAN DIEGO — A California federal magistrate judge has recommended dismissal of a Risperdal case, finding the plaintiff’s failure to comply with discovery requests and the court’s discovery order has prejudiced defendant Janssen Pharmaceuticals Inc.
In an Aug. 3 report and recommendation, Magistrate Judge Barbara Major of the U.S. District Court for the Southern District of California found the plaintiff knowingly, intentionally and willfully failed to respond to Janssen’s discovery requests and ignored a court order requiring him to do so. As such, dismissal is warranted, the judge said.
