FORT MYERS, Fla. — Corin Group is urging a Florida federal judge to dismiss claims of design defect and failure to warn in a hip replacement case, arguing they are preempted because they are not based on state law regulations that parallel federal law.
In a July 9 brief filed in the U.S. District Court for the Middle District of Florida, Corin further argues that the negligence per se claim is barred under Florida law.
