PHILADELPHIA — Zimmer Inc. has moved for summary judgment in a case in which a woman alleges her Kinectiv Technology hip implant system with a VerSys femoral head was defectively designed and manufactured.
In its June 29 motion filed in the U.S. District Court for the Eastern District of Pennsylvania, Zimmer says the plaintiffs’ claims are time-barred, her strict liability manufacturing claim is not cognizable under Pennsylvania law, her claims are not backed by adequate expert testimony, and the warnings provided to her surgeon were adequate.
