SOUTH BEND, Ind. — Biomet Inc. has objected to plaintiffs’ proposed pretrial order regarding remand of some 65 cases on the M2a Magnum hip implant multidistrict litigation docket, arguing it seeks to revive a discovery dispute that was settled five years ago.
In its July 16 objection filed before Judge Robert Miller of the U.S. District Court for the Northern District of Indiana, Biomet maintains plaintiffs’ suggestion that more, uncoordinated discovery of Biomet will be necessary after transfer or remand should be rejected and not incorporated in the court’s remand order.
