CHICAGO — An Illinois federal judge has ordered a new trial in the second bellwether case involving AbbVie’s AndroGel testosterone replacement drug, finding the jury’s verdict for AbbVie on the plaintiff’s strict liability claim was inconsistent with its finding for the plaintiff on the negligence claim.

On July 5, Judge Matthew Kennelly of the U.S. District Court for the Northern District of Illinois vacated the $150 million punitive damages verdict, ruling that the jury’s findings cannot be reconciled because the court required proof of the same “unreasonably dangerous” element for both claims.
