S&N Asks Court to Establish Protocol for Handling Explanted BHR, THA Hip Systems

BALTIMORE — Smith & Nephew Inc. has asked the judge overseeing the BHR Hip MDL docket to establish a protocol for the identification, preservation and handling of explanted devices, arguing that the parties should be required to make a good faith effort to preserve the systems and components.
The proposed Case Management Order No. 9, submitted before Judge Catherine C. Blake of the U.S. District Court for the District of Maryland, also suggests that plaintiffs be required to supplement their Plaintiffs’ Fact Sheets with information concerning the explant procedure, including the location of the explanted system.
