N.Y. Lawsuit Involving Alcon Intraocular Lenses Dismissed as Preempted

POUGHKEEPSIE, N.Y. — A New York judge has dismissed a lawsuit against Alcon Laboratories Inc. involving its intraocular lenses, ruling that the plaintiff’s claims are preempted because they seek to impose requirements that are “different from, or in addition to” federal law.

On June 5, Judge James D. Pagones of the Dutchess County Supreme Court dismissed the plaintiffs’ claims of breach of warranty and negligence.
