M2a Hip Plaintiff Seeks to Reinstate Claims Against Device Designer

SOUTH BEND, Ind. — A plaintiff in a Biomet M2a hip replacement action has asked an Indiana federal judge to reinstate his claims against a Florida doctor who allegedly helped design the device, arguing his failure to timely file briefs supporting personal jurisdiction was excusable.

In a May 8 motion filed before Judge Robert L. Miller of the U.S. District Court for the Northern District of Indiana, the plaintiff further argues that the doctor and his company have already conceded that the plaintiff’s home state of Minnesota is an appropriate forum.
