Corin Moves to Dismiss Amended Complaint in Fla. Federal Cormet Hip Case

FORT MYERS, Fla. — Corin Group has moved to dismiss a first amended complaint in a Cormet metal-on-metal hip case, arguing the design defect, failure to warn, and negligence per se claims are preempted because they are not based on state regulations that parallel federal law.

In a May 18 motion filed in the U.S. District Court for the Middle District of Florida, Corin further argues that the claims are insufficiently pled and, as to the negligence per se claim, barred under Florida law.
