Plaintiff Opposes Motion for New Trial in Bellwether C.R. Bard IVC Filter Case

PHOENIX — The plaintiff who prevailed in the first Bard IVC bellwether case to go to trial has opposed C.R. Bard’s motion for a new trial, arguing the company has failed to show that the $3.6 million verdict was inconsistent.

In a May 7 reply filed in the U.S. District Court for the District of Arizona, Sherr-Una Booker further maintains that under 9th Circuit precedent, the court may not order a new trial based on allegedly inconsistent general verdicts.
