TRENTON, N.J. — An attorney representing four claimants who never filed suit in the Zimmer Durom Hip Cup multidistrict litigation but did participate in mediation have asked a New Jersey federal judge to reduce the common benefit fund assessment to 1 percent for their cases.
In a March 27 motion filed before Judge Susan Wigenton of the U.S. District Court for the District of New Jersey, the attorney explains that liaison counsel did not have an attorney-client relationship with the claimants and did not participate in their cases.
