Zimmer Awarded Summary Judgment in N.Y. Federal Knee Replacement Action

BUFFALO, N.Y. — A New York federal judge has awarded Zimmer Inc. summary judgment in a knee replacement action, ruling that the plaintiff cannot prove the essential elements of his design defect claim because he failed to timely identify any expert testimony.

On April 11, Judge Michael Telesca of the U.S. District Court for the Western District of New York further held that the plaintiff failed to back his allegation that Zimmer engaged in dilatory discovery tactics.
