CHICAGO — An Illinois federal judge has dismissed for lack of personal jurisdiction claims asserted against a Swiss company in a morcellator action, ruling that the company lacked sufficient contacts with the state related to the claims in the lawsuit.
On March 30, Judge John J. Tharp Jr. of the U.S. District Court for the Northern District of Illinois said the fact that Nouvag AG's customer distributed its device through a subsidiary in Illinois does not show that the Swiss company purposefully availed itself of the privilege of conducting activities within Illinois.
