Pa. Appeals Court Upholds Verdict Against Janssen in Risperdal Gynecomastia Case

PHILADELPHIA - A Pennsylvania appellate court has allowed a verdict to stand in a Risperdal case, rejecting Janssen Pharmaceuticals Inc.'s argument that the evidence did not support the jury's finding that the anti-psychotic drug caused the plaintiff's breast growth.

In the Feb. 20 opinion, the Pennsylvania Superior Court also upheld the trial court's application of Maryland's cap on noneconomic damages to the jury award. However, the court remanded the case so the trial court could determine whether New Jersey's restrictive punitive damages law applies, or whether Maryland's more liberal law governs the issue.
