WASHINGTON, D.C. - A federal judge has denied Bayer Healthcare Pharmaceuticals Inc.'s motion for summary judgment, finding sufficient evidence exists that the plaintiff's use of allegedly contaminated alcohol prep pads caused him to develop a serious infection.

On Feb. 2, Judge Colleen Kollar-Kotelly of the U.S. District Court for the District of Columbia also refused to exclude the testimony of the plaintiff's experts, finding they go to the weight, rather than the admissibility, of the testimony and should be explored before the jury.
