Negligence, Breach of Warranty Claims to Proceed in Pa. Federal Hernia Mesh Case

PITTSBURGH - A Pennsylvania federal judge has allowed claims of negligence and breach of warranty to proceed in a Bard Ventralight ST Mesh hernia repair patch case, ruling that the plaintiff adequately pled that the defendants failed to disclose the unreasonably dangerous nature of the polypropylene in the device.
On Feb. 1, Judge Arthur J. Schwab of the U.S. District Court for the Western District of Pennsylvania found the allegations put the defendants on notice that they may have manufactured the Ventralight in a negligent manner such that it caused the plaintiff to suffer harm.
