Holding Company Dismissed from Profemur Hip Case; Claims To Proceed Against Wright Medical Technology

DES MOINES, Iowa - An Iowa federal judge has dismissed Wright Medical Technology (WMT)'s parent corporation from a Profemur hip device lawsuit for lack of personal jurisdiction, finding the company did not design, market or advertise the device in Iowa, or any other state.
However, in the Jan. 26 order, Chief Judge Leonard T. Strand allowed claims of design defect and manufacturing defect to proceed against WMT, finding the plaintiffs sufficiently alleged that a safer alternative to the Profemur existed and that the device departed from its intended design.
