Rezulin Maker Granted Summary Judgment After Man Fails to Prove Use of the Drug Caused Emotional Distress

NEW YORK - The manufacturer of Rezulin was awarded summary judgment in a case where the plaintiff alleged that his use of the diabetes drug caused him to experience emotional distress. In re: Rezulin Products Liability Litigation, MDL No. 1348 (S.D.N.Y.).
U.S. District Judge Lewis A. Kaplan found that the plaintiff did not provide any 'competent' evidence to prove that he suffered any emotional injury as a result of ingesting the drug. The Feb. 20 order also states that the plaintiff could not recover damages under a claim of negligent infliction of emotional distress pursuant to New Mexico law.
