MOUNT VERNON, Ill. — An Illinois appellate court has ordered that a pelvic mesh case be dismissed for forum non conveniens, holding that the private and public interest factors weigh in favor of trying the action in Baltimore County, rather than St. Clair County.
In a Dec. 8 opinion, the Illinois Court of Appeal, 5th District, held that because the remaining plaintiff’s device was implanted in a Baltimore County hospital, and because the witnesses reside in that county, the trial court erred in denying American Medical Systems’ motion to dismiss.
