New Mexico Jury Finds Diet Drug Did Not Cause Woman's Heart Problems

SANTE FE - On Feb. 7, a New Mexico jury handed down a verdict in favor of the manufacturer of Fen-phen in the state's first trial over injuries allegedly caused by the weight loss drug. Josie Garcia v. Wyeth-Ayerst Laboratories, No. D-101-CV-2000-1387 (N.M. Dist. Ct., Sante Fe Cty.).
The jury found that the drug did not cause plaintiff Josie Garcia's heart problems. In addition, the jury concluded that Wyeth, formerly known as American Home Products Corp., did not fraudulently misrepresent information about the dangers of Redux and that the company adequately warned consumers about the drug's association with heart damage. …
