Ala. Federal Judge Orders Briefing on Amount-In-Controversy Issue in DePuy Hip Action

MOBILE, Ala. — An Alabama federal judge has ordered the parties in a DePuy hip replacement action to submit briefing setting forth their positions as to whether the amount-in-controversy has been satisfied for federal subject matter jurisdiction.

On Nov. 2, Judge William H. Steele of the U.S. District Court for the Southern District of Alabama said the complaint is too vague as to the plaintiff’s circumstances for the court to determine whether the damages claimed exceed $75,000.

James Lyon alleges he received two defective implants in 2006, and that those implants were subsequently replaced with other artificial hips in 2016. …
