Pinnacle Hip Plaintiffs Seek to Present Evidence Regarding Other Metal-On-Metal Lawsuits

DALLAS — Plaintiffs in the 4th bellwether Pinnacle hip trial have asked the presiding judge to allow them to present evidence regarding other lawsuits filed in the multidistrict litigation in order to “rebut the misimpression” left by DePuy’s cross-examination of its expert, Dr. Nicholas Athanasou.

In a Nov. 6 trial brief filed before Judge Ed Kinkeade of the U.S. District Court for the Northern District of Texas, the plaintiffs argued that DePuy’s counsel asked questions suggesting that their hip implant failures resulting in early revision surgeries “are unusual or anomalous,” when in fact they experienced the same problems as several …
