DALLAS — Plaintiffs in the ongoing Pinnacle hip bellwether trial have asked a Texas federal judge to reconsider his ruling barring the admission of two deferred prosecution agreements (DPAs) concerning federal criminal charges against DePuy accusing it of paying doctors to use its hip replacement products.
In an Oct. 30 motion filed in the U.S. District Court for the Northern District of Texas, plaintiffs argued to Judge Ed Kinkeade argue that DePuy, despite repeated warnings from the court, continues to “open the door” to the necessity for and admissibility of evidence regarding the DPAs with the U.S. Department of Justice. …
