TAMPA, Fla. — A federal appeals court has upheld a $6.7 million jury award to a Florida woman who said she was injured by Boston Scientific Corp.’s Pinnacle transvaginal mesh device, finding the trial court did not abuse its discretion in trying her claims with those of four other plaintiffs.
On Oct. 19. The 11th Circuit U.S. Court of Appeals further held that the trial court did not improperly exclude all evidence relating to the Food and Drug Administration’s clearance of the Pinnacle device for sale through its 510(k) “substantial equivalence” process.
