NEW YORK — A New York federal judge has refused to reconsider her award of summary judgment to Janssen Pharmaceuticals Inc. on failure-to-warn claims in in a Risperdal gynecomastia case, reiterating that the plaintiff failed to present sufficient evidence that his doctors would have changed their prescribing decisions had they been presented with a different warning.
In an Oct. 24 order, Judge Lorna Schofield of the U.S. District Court for the Southern District of New York adjourned the upcoming trial and ordered Janssen to file a new motion for summary judgment concerning the plaintiff’s claims sounding in fraud, misrepresentation, and …
