DePuy Moves to Strike Expert Witness Nargol’s Supplemental Report in Pinnacle Trial

DALLAS — DePuy and Johnson & Johnson have asked a Texas federal judge to strike the supplemental report of plaintiffs’ expert Dr. Antoni Nargol, arguing that plaintiffs improperly waited until the middle of the Pinnacle hip trial to proffer his opinions without disclosing them to the defendants.

In an Oct. 17 motion to strike filed in the U.S. District Court for the Northern District of Texas, defendants further contend that Nargol lacks the reqisite expertise to opine that the device’s alleged manufacturing defects contributed to plaintiffs’ injuries.
