SOUTH BEND, Ind. — A plaintiff says Biomet Inc. cannot escape its obligations under the M2a Magnum hip master settlement agreement by paying him only $25,000 to settle his claims, rather than $200,000 because his metal-on-metal-related injuries entitles him to the full amount.
In an Oct. 4 reply filed in the U.S. District Court for the Northern District of Indiana, Donald Eastman argues that he is not bound by a release in which he relinquished all claims against Biomet because Biomet breached the terms of the MSA.
