High Court Denies Review of $3.27 Million Verdict in Gynecare TVT-O Transvaginal Mesh Action

WASHINGTON, D.C. — The U.S. Supreme Court has denied Ethicon Inc.’s request to review an appellate court’s affirmation of a $3.27 million verdict in a Gynecare TVT Obturator transvaginal mesh action.
On Oct. 2, the high court denied the writ of certiorari, in which Ethicon challenged the 4th Circuit U.S. Court of Appeal’s ruling that evidence of the TVT-O’s compliance with the FDA’s 510(k) process was properly excluded. The appellate court held that the 510(k) process only “tangentially” examines the safety of the product going through the process.
