DePuy Opposes PSC’s Request for Staggered Remand of Pinnacle Hip Cases

DALLAS — DePuy Orthopaedics has asked the Pinnacle Hip Implant MDL judge to reject the plaintiffs’ request to proceed with staggered remands of New York and California cases, arguing that the court cannot selectively pick off cases that plaintiffs view as favorable and suggest remand of those cases only.
In a Sept. 18 surreply filed in the U.S. District Court for the Northern District of Texas, DePuy argues that all of the cases in the MDL have advanced to the same point — the end of pretrial proceedings — and should be remanded en masse.
