NEW ORLEANS — A Louisiana federal judge has denied new trials to the plaintiffs in the first two Xarelto bellwether cases that ended in defense verdicts, finding no prejudicial harmful errors were made in the court’s evidentiary rulings.
On Sept. 20, Judge Eldon Fallon of the U.S. District Court for the Eastern District of Louisiana said a new trial is not warranted because Joseph Boudreaux and Joseph Orr failed to demonstrate errors of law or fact, newly discovered or previously unavailable evidence, any manifest injustice, or an intervening change in controlling law.
