CHICAGO — An Illinois state judge has granted a plaintiff’s motion for a new trial in a DePuy hip action, ruling that her expert’s testimony regarding the volumetric wear analysis of the ASR Uni Femoral Implant should have been presented to the jury.
In a Sept. 19 order, Cook County Circuit Judge Deborah M. Dooling held that plaintiff Carol Strum was denied a fair trial because she was barred from giving the jury evidence of the amount of wear on her explanted ASR that was vital to her case.
