NEW YORK — A New York federal judge has awarded Janssen Pharmaceuticals Inc. summary judgment in a Risperdal gynecomastia case, finding the plaintiff failed to show that his doctor would not have prescribed the drug had the warnings been more extensive.
On Aug. 30, Judge Lorna Schofield of the U.S. District Court for the Southern District of New York rejected the plaintiff’s argument that the law presumes that his doctor “would have heeded warnings if they had been provided, and that the injury would not have occurred."
