W. Va. Judge Refuses to Dismiss Wright Hip Action, Says Design Defect, Warranty Claims Adequately Pled

CLARKSBURG, W. Va. — A West Virginia judge has refused to dismiss a lawsuit filed by the widower of a woman who died after undergoing implantation of a Wright Medical total hip replacement and six subsequent revision surgeries, finding the claims of design defect and breach of warranty were adequately pled.

In an Aug. 16 order, Judge James A. Matish of the Harrison County (W. Va.) Circuit Court further held that the plaintiff met his burden of showing that the court has general and personal jurisdiction over Wright Medical Group.
