Zimmer Moves for Summary Judgment in 95 NexGen Knee Cases, Says Causation Testimony Unreliable

CHICAGO — Zimmer Inc. has moved for summary judgment in the NexGen Knee Implant multidistrict litigation as to 95 cases in which plaintiffs’ experts executed declarations without reviewing X-rays, arguing that it renders the experts’ causation testimony unreliable.
In an Aug. 1 motion filed in the U.S. District Court for the Northern District of Illinois, argued that in accordance with recent rulings, a reliable medical causation opinion in cases involving alleged loosening of total knee replacement system requires X-ray review.
