PHILADELPHIA — A Pennsylvania federal judge has denied Merck & Company Inc.’s motion for partial summary judgment in a lawsuit alleging that its over-the-counter MiraLAX causes serious kidney issues, ruling that the motion is premature.
On Aug. 7, Judge Joel Slomsky of the U.S. District Court for the Eastern District of Pennsylvania said the parties should proceed with the first phase of the bifurcated discovery plan, which is limited to the issues of proof of injury and medical causation.
